Democrats' long-shot plan to stop Trump's Supreme Court pick

President Trump is slated to announce his nominee to replace retiring Supreme Court Justice Anthony Kennedy tonight. Have not made it final.

At a White House ceremony announcing the pick, Trump described Kavanaugh as a man of "impeccable credentials" and a "true thought leader among his peers". During that tenure, he's proven to be one of the most thorough and thoughtful jurists in America. But his decision and status as the court's swing vote on a number of social issues left liberals anxious the court would soon become more conservative under Trump's watch.

"Judge Kavanaugh possesses an impressive resume, an outstanding legal mind, and an exemplary judicial temperament", McConnell said.

Conservatives have taken issue with a potential Kavanaugh nomination, with some critics on the right citing his closeness to the Bush 43 administration while others believe he doesn't have a strong enough stance against abortion.

All three voted a year ago to confirm Trump's first Supreme Court nominee, Neil Gorsuch, and the White House invited them to meet with Trump last month to discuss the latest opening on the court. "What matters is not a judge's political views but whether they can set aside those views to do what the law and Constitution require", Trump said.

Trump announced Kavanaugh as his pick Monday night on prime-time television.

Besides Kavanaugh, other top contenders were federal appeals judges Raymond Kethledge, Amy Coney Barrett and Thomas Hardiman. They sought someone with a long track record that included most of the controversial issues likely to come before the high court.

But his supporters note his experience and a wide range of legal opinions.

Democrats who plan to oppose Trump's nominee are focusing on two Republican moderates, Susan Collins of ME and Lisa Murkowski of Alaska, hoping to turn them against Trump's selection. Joe Donnelly (Ind.), Heidi Heitkamp (N.D.), and Joe Manchin III (W.Va.) - voted to confirm Neil M. Gorsuch, Trump's first Supreme Court nominee.

But whether Senate Democrats will stay united in opposition to Kavanaugh also is in question.

Groups that support abortion rights are planning a "Day of Action" for August 26, the anniversary of the 1920 adoption of the 19th Amendment giving women the right to vote.

Three Democrats who were invited but declined were Sens. Heidi Heitkamp of North Dakota, Joe Donnelly of IN and Joe Manchin of West Virginia. Feinstein is the ranking Democrat on the Judiciary Committee.

"The Republicans control the votes in the Senate, but we have the American people on our side", he said. She once called a 1992 Supreme Court decision that upheld Roe v. Wade "erroneous".

At the top of issues that will be closely watched is abortion.

Within Republican ranks, Senator Susan Collins has already signalled she could break with her party if Trump taps someone hostile to the landmark 1973 Roe v. Wade ruling that guaranteed women's access to abortion.

A graduate of Yale University and Yale Law School, Kavanaugh - the only one of Trump's four finalists who has an Ivy League degree - will be in good company on a court where all the current justices have gone to law school at Harvard or Yale. He also was a key aide to Kenneth Starr during Starr's investigation of President Bill Clinton, worked on behalf of George W. Bush's campaign during the election recount in 2000 and served in the Bush White House.

A fellow judge there, Maryanne Trump Barry, one of the president's sisters, reportedly has recommended him to her brother.

That increases the focus on two Republicans - Sen. So it's in the president's interest to pick someone who can be confirmed quickly. The White House said Monday that former Arizona Sen.

With the Senate's Republican leadership saying it aims to complete the confirmation process before November's midterm elections, Democrats were nearing panic mode.

Kyl retired from the Senate seat now occupied by Jeff Flake in 2013 and has been working for Washington-based lobbying firm Covington & Burling. The White House hopes Kyl's close ties to Senate Republicans will help smooth the path for confirmation.

A GOP official said Senate Majority Leader Mitch McConnell had suggested Kyl for the task.

What Could Complicate Kavanaugh's Nomination?

Any of the candidates on Trump's short list would probably move the court to the right.

Some of the protesters got on 5th Ave. and laid down on the roadway in front of Trump Tower.

Democrats say McConnell is being hypocritical in moving forward with the nomination.

After about 30 minutes, some of the protesters, including Brooklyn City Councilman Jumaane Williams, were arrested.

"She has made clear - as she said to the president in person two weeks ago - that she considers fully vetting Supreme Court nominees one of the most important jobs of any US senator, and she plans to fulfill that critical duty", the spokesperson said.
